Nothing is sending yet

Read this first, because it is the most important thing on the page.

Texting is not switched on at launch. We collect and store consent now so that the program is ready, but we are not sending marketing texts yet. Nothing has been sent, and nothing will be sent until the program is switched on.

While the program is off:

  • We may send you a transactional text you asked for at that moment, such as the link to a guide you just requested. That is the message you asked us to send, and nothing else.
  • We send no marketing texts and make no marketing calls.
  • If you ticked the consent box and more than 12 months have passed before we send you a first marketing text, we will email you first and ask you to confirm again. If you do not confirm, we do not text you.

When the program does switch on, these terms are the terms it runs under.

The program

Program name: Loading Academy alerts.

Operated by: Loading Academy, operated by Alwaysloading Ventures LLC.

Purpose: what you get if you opt in are text alerts about Loading Academy. Reminders for a training you registered for, the link to a guide or resource you asked for, notices about your account and your access, occasional news about what we are opening or closing, and offers.

Message frequency: message frequency varies, up to 8 messages a month. Some months will have none.

Msg & data rates may apply.

Cost: we do not charge you anything for the messages. Your mobile carrier may charge you for receiving them, depending on your plan.

How to opt in

You opt in by ticking a box that is separate, optional and not ticked in advance, and by giving us your mobile number. The box sits by itself, and it says what you are agreeing to.

Consent is not a condition of purchase. You do not have to agree to texts to buy anything from us, to get a guide, to register for a training, or to use anything we sell. If a form asks for your phone number, that is so we can send you the thing you just asked for. Ticking the marketing box is a separate choice, and saying no changes nothing about what you receive otherwise.

The phone field itself is required in the United States and optional everywhere else. If you are in the US, you give us a number so we can send you what you asked for. If you are outside the US, you can leave it blank and still get everything. Either way, the number alone is not consent to marketing texts. Only the tick is.

You may only opt in if you are 18 or older and the number is yours.

How to stop

Reply STOP to any message. You will be unsubscribed straight away. We will send one message confirming that you are unsubscribed, and after that we stop.

You can also email support@loadingacademy.com and ask us to remove your number. We will do it and confirm.

How to get help

Reply HELP to any message, and you will get a reply with our contact details. Or email support@loadingacademy.com at any time. We reply within one business day.

When we send

We send only between 9am and 8pm in your local time. We work out your local time from your area code or from a location you have given us. We do not send outside that window.

Where the program runs

United States only. We do not send text messages to numbers outside the United States. If you are outside the US, do not opt in, and we will not text you.

Carriers

Carriers are not liable for delayed or undelivered messages. Mobile carriers are not responsible for messages that arrive late or do not arrive at all. Delivery depends on your carrier, your device, your signal and your plan, and none of those are within our control. Not every handset and not every carrier supports every kind of message.

Your information

The mobile number you give us is used to run this program and to send you the things described above. We do not sell your information. We share it only with the service providers that help us operate, such as our payment, email and messaging providers.

When you consent, we record the date and time, your IP address, the page URL you consented on, and the exact version of the consent text you agreed to. We keep that record so we can show what you agreed to and when.

Changes

If we change these terms, we update the date at the top of this page and the version number. If a change is material, we tell the people on the program before it takes effect.

Governing law

These SMS Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Venue and any arbitration sit in Florida, as set out in our Terms.
